References to “owner/agent”, or “owners/agents” are to the person or persons who own/s the rental property/s, or who is the agent representing the owner. References to “renter” or “renters” relates to the person, or persons renting the property.

References to “the user”, or “users” relates to anyone using the website, whether an owner/agent or a renter.

ACCEPTANCE OF TERMS

By accessing the content of the Website you agree to be bound by the terms and conditions set out herein and you accept our privacy policy available at [www.justdirect.net/privacy-policy.htm]. If you object to any of the terms and conditions set out in this agreement you should not use any of the services of the Website and leave immediately.

In using the website you agree to be fully responsible for any claim, expense, liability, losses, costs including legal fees incurred by us arising from any infringement of the terms and conditions set out in this agreement.

MODIFICATION

We reserve the right to change any part of this agreement without notice and your use of the Website will be deemed as acceptance of this agreement. We advise users to regularly check the Terms and Conditions of this agreement.

We have complete discretion to modify or remove any part of this site without warning or liability arising from such action.

WEBSITE DESIGN & CONTENT

As owners and administrators of the website, we reserve the right at any time, and without prior notice, to alter the design and information architecture of the website, including editing, adding or deletion of content provided, in whatever format, by the owner/agent for display in their property advert/s. We reserve the right at any time to delete or suspend property advert/s provided by the owner/agent, without prior notice, for whatever reason.

JustDirect.Net will under no circumstance be liable for any loss or damage as a result of changes to the website and content made by us.

UNAUTHORISED USAGE

All users of the website are prohibited from:

• Making illegitimate enquiries to owners/agents other than to enquire about a rental property, or ‘spamming’ the owner/agent with information about products or services, whether related or not;
• Creating false, fraudulent, exaggerated, or inaccurate property advert/s that could mislead the renter, or entering false, or incomplete information when registering;
• Uploading or transmitting content, in whatever format, that could be considered by other users, whatever their ethnicity, religion, sexual preference or age, as offensive, libellous, pornographic or provocative as to incite a criminal offence or unlawful behaviour;
• Making a false, fraudulent or speculative booking enquiry to the owner/agent to attempt to ‘block’ other users from reserving that property;
• Uploading or transmitting to the website any data, in whatever format, that contains a virus, Trojan horse, worm, or any other program that is specifically designed to harm or impede the daily operation of the website;
• Intercepting and capturing data transmitted between users and/or accessing, or attempting to access, secure areas without our prior permission.

LIMITATION OF LIABILITY

JustDirect.Net will under no circumstance be liable for indirect, special, or consequential damages including any loss of business, revenue, profits, or data in relation to your use of the Website.

Nothing within this Agreement will operate to exclude any liability for death or personal injury arising as result of the negligence of JustDirect.Net; it’s employees or agents.

COPYRIGHT & OWNERSHIP

All intellectual property of JustDirect.Net such as content, trademarks, trade names, patents, registered designs, logos and any other automatic intellectual property rights derived from the aesthetics or functionality of the Website, together with all data contained within all databases, remain the property of JustDirect.Net.

In creating a property advert, owners/agents confirm that they own the copyright of all content, in whatever format submitted to us via the website, or otherwise, or have the written permission of the copyright owner. Owners/agents agree to grant us a royalty-free licence to utilise the content provided for display on the website and also for marketing and public relations purposes, whether online or off-line.

Under no circumstances will JustDirect.Net be held liable for damages incurred by copyright infringement by the owner/agent and the owner/agent agrees to, upon demand, fully indemnify JustDirect.Net for any administrative, legal or any other costs incurred by us arising out of their copyright infringement.

By using the Website you agree to respect the intellectual property rights of JustDirect.Net. You agree to refrain from copying, distributing, republishing, transmitting, reverse engineering, uploading, offering for sale, licensing, or selling any content contained within the Website for any commercial purpose by you or any third party, without our prior consent.

For the sole purpose of users locating holiday properties to rent, we permit users to download property adverts and print this information, where our copyright notice must be clearly shown, and the details printed not distributed to any third party. For the same purpose, we also permit registered users to create property ‘shortlists’ and transmit details of individual properties to third parties by email.

In transmitting details of individual properties to third parties by email, you agree to take full responsibility for any infringement of copyright or our intellectual property rights, as detailed above, by any third party. Upon demand, you agree to fully indemnifyJustDirect. Net for any administrative, legal or any other costs incurred by us arising out of any infringement.

We therefore recommend that you make all third parties aware of our Terms & Conditions and your obligations under this agreement, when transmitting property information by email.

DISCLAIMERS

The information is provided on the understanding that the website is not engaged in rendering advice and should not be wholly relied upon when making any related decision.

The information contained with the Website is provided on an “as is” basis with no warranties expressed or otherwise implied relating to the accuracy, fitness for purpose, compatibility or security of any components of the Website.

Although we vet and monitor all property adverts placed on the website by owners/agents, we can under no circumstances be held liable for any inaccuracies, or exaggerations, in the information posted and displayed, in whatever format.

Upon demand, the owner/agent agrees to fully indemnify JustDirect.Net for any administrative, legal or any other costs incurred by us arising out of any inaccuracies, or exaggerations in the content, in whatever format, displayed on any property advert.

Nor can we be held liable for any inaccuracies, or exaggerations, in the information posted and displayed, in whatever format, on owner/agent websites linked to the website. These websites are the sole responsibility of the owner/agent and should have their own Privacy Policy and Terms & Conditions of use.

We therefore strongly recommend that prior to making any decision or payment, the renter checks all information displayed for its accuracy and authenticity, by contacting the owner/agent. A ‘Contact’ button is provided on each property advert for the renters’ convenience. Furthermore, if a link to the website of the owner/agent is provided, then we also recommend that the renter accesses this website to gain further information before proceeding further.

Under no circumstances can we be held liable for any inaccuracies in the ‘availability calendar’ displayed on a property advert, nor for any inaccuracies of the daily rates applied to each day to enable a quotation to be generated. The management of this calendar and the daily rates applied is the sole responsibility of the owner/agent.

Upon demand, the owner/agent agrees to fully indemnify JustDirect.Net for any administrative, legal or any other costs incurred by us arising out of any inaccuracies displayed in the ‘availability calendar’, or for any inaccuracies of the daily rates applied to each day.

We do not guarantee uninterrupted availability of the www.justdirect.Net website and cannot provide any representation that using the website will be error free. Periodically, interruption may occur while updating, or backing up the website.

JustDirect.Net will under no circumstance be held liable for any loss of business or damages as a result of the website, or its functionality being temporarily unavailable, nor held liable for downtime incurred by its agents or third party service providers.

THIRD PARTIES

The Website may contain hyperlinks to websites operated by other parties. We do not control such websites and we take no responsibility for, and will not incur any liability in respect of, their content. Our inclusion of hyperlinks to such websites does not imply any endorsement of views, statements or information contained in such websites.

SEVERANCE

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall remain in force.

GOVERNING LAW AND JURISDICTION

The laws of England will govern this Agreement and any user of the Website hereby agrees to be bound exclusively by the jurisdiction of English courts without reference to rules governing choice of laws.

JUSTDIRECT.NET WEBSITE

INTRODUCTION

To advertise a holiday rental property on the website is FREE. The number of individual rental properties that can be advertised at any time is unlimited. Property Agents, as well as individual property owners, are welcome to use the website, to advertise as many properties as they wish.

By clicking the ‘Accept Terms & Conditions’ click box when placing a property advert, you agree to abide by the following Terms & Conditions at all times. The date, in which you agree to abide from, is the date you tick this box. This date is recorded in our database.

HOW WE WORK

JustDirect.Net is a website for owners and agents of privately owned holiday rental accommodation to advertise rental properties totally FREE OF CHARGE.

Our mission is to build the world’s largest searchable database and network of holiday rental properties. In order to achieve this, we have removed all of the normal obstacles owners and agents often face when promoting holiday rental properties.

We charge no annual advertising fees, no commission per booking, no charges ‘per click’, or ‘per enquiry’. Nor do we have ‘hidden’ charges, or offer complex ‘add-ons’ that no longer make the service free. We also allow owners and agencies to link to their own website completely free of charge on the agreement of a small reciprocal link to our website.

The quality of our property adverts and our service to members is not compromised simply because we offer this service for free. Our property adverts are considered comprehensive, but user-friendly. The functionality and features of the website are equivalent, if not superior in some cases, to our competitors.

Property owners benefit by: managing their own booking enquiries, vetting potential renters prior to accepting a booking, retaining the full booking amount, minimising their advertising spend, maximising their profit, applying their own Terms & Conditions and being allowed to link to their own property website – all free of charge.

We provide owners/agents with a ‘loyalty scheme’ so they can earn points and enhance their listing position in our search results for a specific geographical area. Points are built up by tracking referrals from their website to our website. Each unique referral is worth one point.

The number of points that an owner/agent has built up can be viewed at anytime by accessing their Members Area and these can be compared with fellow owners/agents, advertising in the same geographical area. There is also a global list of leading referrers.
 

WE AGREE TO

Subject to the terms & conditions set out above, we agree to:

• Provide a totally FREE facility for owners/agents to advertise any number of holiday rental properties, for as long as they wish;
• Provide registered users (Members) with a facility to contact the owner/agent directly to make a general enquiry about the rental property, or check availability;
• Provide a secure Members Area, where the owner/agent can: update existing adverts; amend their contact details/password; update, or switch on/off, the availability calendar/s; view their loyalty points account; utilise loyalty points gained; as well as receive news about company or website developments;
• Provide a comprehensive Availability Calendar, that can be switched on/off, so the owner/agent can: provide availability up to 3 years in advance; specify a daily rental rate; mark specific days as a special offer; mark specific days as booked, available, not available, unassigned, or on request/provisionally booked. Thus enabling users to obtain an ‘instant quote’ prior to proceeding to contacting the owner/agent;
• Provide a comprehensive ‘Knowledge Base’ that includes an advanced search facility to help Members locate specific information or assistance in relation to any aspect of the website, its functionality and processes;
• Provide contact email addresses to provide further assistance, should it be required;

YOU AGREE TO

As an owner/agent and subject to the terms & conditions set out above, you agree to:

• Advertise one rental property per advert. Multiple property units at one site, must be individually listed;
• Provide and upload at least one photograph of the property per advert. Please note that we do not provide a photograph scanning facility;
• Update the provided Availability Calendar, as and when necessary, unless you have switched this facility ‘off’ in the Members Area;
• Provide a reciprocal link to our website, should you wish to link to your own website from the property advert and earn loyalty points to be placed higher in our search results and gain free promotion on our home page and other pages;
• Not provide a reciprocal link to any main competitor website, offering a similar searchable database resource to us;
• Manage all enquiries from any party interested in renting a property and all confirmed bookings, including: the issue of necessary correspondence, receipt and acknowledgement of payments, cancellations, refunds, access requirements and any disputes that may arise.
• Provide any necessary Insurance and ensure that all properties listed conform to the required governing legislation;
• Suspend a property in the Members Area, should it no longer be: under your ownership, available for let as holiday accommodation, temporarily unavailable, not conform to governing legislation, or any other reason as to not be suitable to let.
